Can you get tattooed in your hotel room?

We offer private in-villa and in-suite tattoo sessions where local ordinances allow it. Note the second half of that sentence, because it is doing an enormous amount of work, and it is the reason we will sometimes tell you no.

Here is the thing most people do not know, and it is the single most important idea on this page.

In most developed jurisdictions the premises are licensed, not just the artist. A brilliant, fully licensed tattooist is still operating unlawfully if they are doing it in a place that is not registered for it.

Which means a hotel room session is usually unlawful unless it is separately permitted as a temporary or event location. Not frowned upon. Unlawful.

The United States, where there is no single answer

There is no federal rule. State and county variation is the entire story, and anyone who tells you “US law says” anything about this is guessing.

Florida is about as blunt as legislation gets: a person “may not tattoo the body of any human being in this state except at a tattoo establishment or temporary establishment licensed under this section” (Fla. Stat. 381.00777).

Texas requires studios to be in a permanent, non-dwelling building, fully partitioned floor to ceiling from any living quarters with no access to them. Temporary locations are allowed, but for no more than seven days and only in conjunction with a single event (Texas DSHS rules). Read that against the idea of a hotel suite and you can see the problem immediately.

California’s Safe Body Art Act sets statewide minimums, requires practitioners to register in each county, and permits work only in a permitted body art facility or an approved body art event (Placer County).

Oregon requires a facility licence in addition to individual practitioner licences, and facility owners may use only licensed practitioners in licensed facilities (Oregon Health Authority).

New York State defines a tattoo studio as “any premises in which the tattooist conducts such practice” (NY DOH Article 4-A), and New York City adds its own DOHMH licence on top.

Local health departments are not subtle about this either. They actively warn against home and hotel “tattoo parties” and describe them as illegal and unlicensed (Wetzel-Tyler County Health Department, July 2025; Wheeling-Ohio County Health Department).

There are narrow exceptions. Some jurisdictions permit mobile operations under tight limits, such as a county ordinance allowing mobile tattoo businesses only at special events of 14 days or less, with permits filed 14 days in advance (Daviess County, Indiana). North Carolina has considered enabling legislation for mobile parlours (NC H.B. 830).

So the honest US answer is: check the county, every time. We do.

England and Wales, where there is a real nuance

Under the Local Government (Miscellaneous Provisions) Act 1982, a person may not carry on a tattooing business unless registered by the local authority, and may only do so in premises registered for that business. But the same section contains a carve-out that matters: a registered practitioner does not breach the premises rule “merely because” they sometimes visit people at their request to tattoo them (legislation.gov.uk, section 15).

That is a genuine, statutory route for a visiting session in England and Wales, and it is narrower than it sounds. Councils are clear that both artist and premises normally need registering, including where an artist sets up at a domestic property (Stafford Borough Council; Buckinghamshire Council). Scotland and Northern Ireland run separate regimes that we have not covered here.

Thailand, Mexico, Japan, the EU

Thailand classifies tattooing as a business hazardous to health. A Ministry of Public Health notification published in the Royal Gazette on 2 January 2020 requires artists to hold an annual health clearance, with a medical certificate confirming no hepatitis B, hepatitis C or TB, plus demonstrated knowledge of infection prevention and waste disposal. Tattooing for religious belief is exempt, which is how sak yant continues at temples (Royal Gazette notification; Bangkok Post).

Mexico’s federal regulation on sanitary control of products and services expressly covers tattoo, micropigmentation and piercing services. Artists need a tarjeta de control sanitario valid for two years, and the application must state the address of the establishment and its operating hours (Reglamento, articles 224 Bis 1 to 2). COFEPRIS requires an Aviso de Funcionamiento for the premises (COFEPRIS self-verification guide). The regime is anchored to premises, so villa work sits outside it.

Japan settled a different question. On 16 September 2020 the Supreme Court affirmed that tattooing without a medical licence does not violate the Medical Practitioners’ Act, ending years of prosecutions (case note; Japan Times). We could not find an authoritative source on Japanese premises or hygiene licensing for studios, so we are not going to assert one.

The EU has no union-wide premises licence. Hygiene and premises rules are national or regional. What is EU-wide is ink chemistry: since January 2022, REACH restricts carcinogens, mutagens, reprotoxins and skin sensitisers in tattoo inks (ECHA).

Bali, which we get asked about most

We are based in Indonesia a good part of the year, so this comes up constantly, and we are going to be straight with you. We could not locate an Indonesian statute or Ministry of Health regulation specific to tattoo premises licensing. Secondary sources claim there is no specific tattoo licence and that shops are regulated as general businesses, but we could not verify that against a primary source and we are not going to repeat it as fact.

Unclear is not the same as permitted. When the legal position cannot be established, we work with established studios that can show us their paperwork, rather than assuming a gap in our research is a gap in the law.

What this means for planning your trip

Practically, four things.

  • We verify before we offer. If in-villa is legally available where you are going, we will arrange it. If it is not, we will say so and book a studio session instead. We will not quietly do it anyway.
  • Studio is not the consolation prize. The best artists in most cities work in licensed studios with proper autoclaves, proper waste handling and inspection records. The room is usually the safer product, not just the legal one.
  • Be suspicious of anyone who says yes too fast. If an artist abroad agrees to a hotel room session without a word about local rules, that tells you something about the rest of their practice too.
  • Rules change and we are not your lawyer. This page reflects sources current as of September 2026. We check the position for your specific destination at the time of booking, because that is the only version that counts.

We know “no” is not what anyone wants to hear when they have pictured a private session with a view. But this is exactly the sort of thing you hire an advisor to find out before you have paid a deposit, not after.
